Sotomayor peppered the lawyers with questions in a pair of cases, joining with Justices Antonin Scalia and Ruth Bader Ginsburg during the oral arguments. Together, they left the other justices sitting in silence for much of the time.

In the first hour alone, Sotomayor asked 36 questions, and Scalia followed with 30. Ginsburg is particularly interested in legal procedures, and she and Sotomayor dominated the questioning for much of the second hour.

otherwise, what? You might think she just doesn’t care. Or her mind is already made up and she doesn’t need to be bothered engaging with the actual case. Like, oh, I dunno this guy?

This would be so fitting. Talking Points Memo is speculating that reprehensible lobbyist-screwing recently-former Orange County Assemblyman Mike Duvall was setup by the dude who was listening to his nasty talk.

The OCR notes that in KCAL’s report, Miller’s face is obscured “to protect our sources.” In fact, it says, some people think Miller may have engineered the whole incident: “Many in the Capitol speculate that Miller reached over and turned on Duvall’s microphone while they were chatting.”

And here’s something else that we noticed in reviewing a different version of the video on the OCR’s site. (The video has always been available online through the public access network that broadcasts the hearings — but it’s clear that no one would have noticed the comments, which are barely audible, without being alerted to their existence): Just as Duvall is talking about his first mistress — who’s been identified in press accounts as lobbyist Heidi DeJong Barsuglia — Miller asks: “Is there someone else?” That prompts Duvall to launch into a description of his second mistress, “Shar” or “Sher.” It’s a strange place in the conversation for Miller to ask that question.

Probably Miller was just sick of the inane and just plain pathetic bragging of Duvall and wanted to get his ass out of the Assembly.

That’s right. It is not just crazed flatulant loonies anymore. Even the right-wing is addressing the stories that are out there. It is being said that Glenn Beck raped and murdered a young girl in 1990.

When will he answer? Why is Glenn Beck not on the Sunday talk show circuit providing the full, official police report?

They should convene a panel for the next Meet the Press with Jenna Bush Hager, Luke Russert, Liz Cheney, Megan McCain and Jonah Goldberg, and they should have Chris Wallace moderate it. They can all bash affirmative action and talk about how vitally important it is that the U.S. remain a Great Meritocracy because it’s really unfair for anything other than merit to determine position and employment.
